Terms of Service

These Terms govern your access to and use of the Igni data services operated by PermitPulse (the "Service"). The Service is for business use only and is not offered to consumers.

These terms are being finalized; for the current binding version contact legal@igni.pro.

1. Acceptance and business use

By creating an account, calling the API, or otherwise using the Service, you ("Customer") agree to these Terms on behalf of the business entity you represent. The Service is provided for your own internal business purposes only and is not offered to, or intended for, consumers.

2. Service description

Igni provides access to structured permit intelligence ("Permit Data") via API, webhooks, email digests, and a web dashboard, subject to the entitlements and quotas of your subscription tier. The Service identifies and classifies residential and accessory-dwelling-unit (ADU) permits sourced from public government records and delivers matching leads according to your configured filters.

Owner-contact information (telephone or other contact data for property owners) is a separate, optional, feature-gated product, is off by default, may be unavailable, and is subject to additional terms before it can be enabled.

3. Data sources and accuracy disclaimer

Permit Data is sourced from publicly available government records. Government records may be incomplete, delayed, mis-keyed, or inaccurate at the source. Igni-generated classifications (including ADU typing and SB-9 / SB-10 flags) are automated estimates, not legal determinations of zoning eligibility, permitting status, or entitlement.

  • The Service is provided "AS IS" and "AS AVAILABLE."
  • Source availability is not guaranteed. A government source may go offline, change its schema, block automated access, or restrict its data at any time, and we may add, remove, or modify sources without notice.
  • You must independently verify Permit Data before taking any action (for example, contacting a property owner or making a lending or construction decision).
  • SB-9 / SB-10 eligibility flags are informational signals, not legal opinions or determinations.

4. License and permitted use

Subject to these Terms and payment of applicable fees, Igni grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and the Permit Data delivered to you for your own internal business purposes only.

5. Use restrictions

You shall not, and shall not permit any third party to:

  • Resell, redistribute, sublicense, publish, or otherwise make available raw Permit Data or owner-contact data beyond the internal-use license, including bulk export for redistribution;
  • Use the data to train, build, or improve a competing product or dataset, or to create a derived database for distribution;
  • Use any owner-contact data for unlawful telemarketing or outreach, including any use that violates the TCPA, the FTC Telemarketing Sales Rule, applicable Do-Not-Call rules, or reassigned-number obligations;
  • Circumvent quotas, rate limits, entitlement gating, or access controls, or share API keys;
  • Use the Service in violation of applicable law, or to harass, defraud, or harm any person.

You are responsible for all activity under your account and API keys. We may suspend or terminate access immediately for abuse, security risk, or breach of these Terms.

6. Fees, tiers, and quotas

Fees, quotas, and entitlements are set by your tier and any applicable order form. Quotas are enforced per the Service's ledger (per calendar month, UTC). A delivered lead counted against quota remains counted even if a notification transport (such as a webhook) subsequently fails, because the lead remains available via the API and dashboard.

During the current pilot, billing is not yet enabled and paid tiers are provisioned on an honor-system basis.

7. Service levels

Any stated uptime, freshness, or precision figures for non-Enterprise tiers are non-binding targets, not contractual commitments, and carry no remedies. A contractual service-level agreement is available only for the Enterprise tier under a signed order form. Freshness depends on third-party government sources; source downtime, latency, or blocking is excluded from any freshness expectation.

8. Modification of the dataset

We may modify, correct, delete, or suppress records at any time, including to comply with privacy law (for example, the California Delete Act or GDPR objection rights). Deletion or suppression of records is not a breach of any data-completeness expectation.

9. Warranties and disclaimer

EXCEPT AS EXPRESSLY STATED, THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND PERMITPULSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of liability

  • No indirect, incidental, special, consequential, exemplary, or punitive damages, and no lost profits, revenue, data, or goodwill.
  • Each party's aggregate liability under these Terms will not exceed the fees paid or payable in the twelve (12) months preceding the event giving rise to liability.
  • Carve-outs apply for your indemnification obligations, breach of confidentiality, breach of the use restrictions, and amounts that cannot be limited under applicable law.

11. Indemnification

You shall defend, indemnify, and hold harmless Igni and its affiliates from any third-party claim, loss, or liability arising from your use of the Service or any data (including any outreach to property owners), your breach of these Terms or the use restrictions, or your violation of applicable law.

12. Term, termination, and changes

These Terms apply while you use the Service. Either party may terminate for material breach that remains uncured after notice. We may suspend or terminate immediately for abuse, security risk, non-payment, or breach of the use restrictions. On termination your license ends and you must stop using and, where required, delete the data.

We may update these Terms by posting a revised version and updating the "Last updated" date; for material changes we will provide reasonable notice. Continued use after the effective date of changes constitutes acceptance.
